These Terms of Service (“Terms”) govern the use of services provided by Iconic Game Servers (“we”, “us”, “our”). By purchasing, accessing, or using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our services.
1. Services
Iconic Game Servers provides game server hosting and related services. Services are provided on a subscription basis unless otherwise stated.
We reserve the right to modify, suspend, or discontinue any service at any time, with or without notice, where reasonably necessary.
2. Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
3. Acceptable Use
You agree to comply with our Acceptable Use Policy, which forms part of these Terms.
Prohibited activities include, but are not limited to:
- Illegal content or activities
- Abuse, harassment, or malicious behaviour
- Malware, botnets, or unauthorised network activity
- Attempts to bypass service limitations or security measures
- Excessive resource usage impacting other customers
Violations may result in suspension or termination without refund.
4. Billing & Payments
- All services must be paid in advance unless otherwise agreed.
- Prices, billing cycles, and renewal terms are displayed at the time of purchase.
- Failure to pay may result in service suspension or termination.
- We reserve the right to adjust pricing with reasonable notice.
Payment processing is handled by third-party payment processors. We do not store full payment card details.
5. Refunds & Cancellations
Refunds and cancellations are governed by our Refund and Cancellation Policy, which forms part of these Terms.
Unless explicitly stated otherwise:
- Setup fees are non-refundable
- Services terminated for policy violations are not eligible for refunds
6. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability.
Maintenance, updates, outages, or events beyond our control may result in temporary service interruptions. Where applicable, uptime guarantees are defined in a separate Service Level Agreement (SLA).
7. Data & Backups
- You are responsible for maintaining your own backups unless backup services are explicitly included.
- We are not responsible for data loss caused by user actions, software issues, or force majeure events.
- Data retention following service termination is outlined in our Privacy Policy.
8. Intellectual Property
All trademarks, branding, and materials provided by Iconic Game Servers remain our intellectual property.
You retain ownership of content you upload, but grant us a limited licence to store and process it solely to provide services.
9. Suspension & Termination
We may suspend or terminate services or accounts if:
- These Terms or any policy are violated
- Payment obligations are not met
- Continued service poses security, legal, or operational risk
Termination does not relieve you of outstanding payment obligations.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the affected service during the previous billing period
Nothing in these Terms limits liability where it cannot be excluded under UK law.
11. Indemnification
You agree to indemnify and hold Iconic Game Servers harmless from claims, damages, or expenses arising from your use of our services or violation of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Northern Ireland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
